Initially, a contract is made with the parties involved who are a couple and a surrogate mother and if she has a permanent partner, he would also sign the contract, which stipulates that the surrogate mother would not be the biological mother of the baby since she is not the contributor of the ovule, therefore, would not have any legal rights over the baby, in the same way the rights and duties of each party involved are included.

At the end through a DNA test and a judicial process, it will be certified that the surrogate mother is not the biological mother, so she would not have legal rights and thus the contributors of the genetic material would remain on the birth certificate.
